One of our fans sent us this link: http://www.rebelliouspixels.com/2013/buffy-vs-edward-remix-unfairly-removed-by-lionsgate Essentially, it's a case where a video recognized, in writing, as being proper application of Fair Use by the US Copyright Office was still unable to get a break from Youtube. That channel was subjected to punishments, sanctions, and so forth, not for breaking the law, but for questioning Youtube's arbitration of ownership rights. Our case is weaker than the one above since we lack direct recognition by the US Copyright Office, and the above situation took months to resolve. Ultimately, we could probably win a battle, but it will be exhausting and Youtube will bring the problem to us again in the future, and we'll have to fight again. As one note, I would like to point out that Youtube is absolutely the cause of the problem. Hasbro is fully within it's rights to question our use of their material. They can put forward these claims as often as they want. However, I don't believe Youtube has the legal authority to decide who actually owns a work. Yet here we are, with my rights to these videos no longer in my control, and third parties are making money I never consented to give. I don't care if Warner Bros. wants to generate revenue from a stupid parody I made of Harry Potter, not that they need the extra nickels and dimes, but it would be nice if somebody asked. -edit- Sorry guys! Just to clear up confusion, when I said "we're moving to Blip", I just meant we'd start hosting the Mentally Advanced Series there. However, every new video will still go to Youtube until they arbitrarily take the videos down. Rainbow Dash Presents and everything else will still be here.
