Courts have been a bit all over the place in deciding how the law should be handled with digital programs, and it's likely that Bethesda and Steam were going to be at the center of their own legal controversies had they maintained their "pay us for other people's mods" system which made many assumptions and sought to seize vast amounts of intellectual property.
